Forty-six-year-old Bart Holt also agreed to forfeit two computers, a Web camera, a cell phone and a 1992 Lincoln used in committing the crimes.

Assistant U-S Attorney Marcia Hurd said Holt used an Internet chat room to carry on a conversation with an F-B-I agent posing as a girl under the age of 16. The two had conversations over several months.

In July 2005, Holt made arrangements to travel to Billings to have sex with the "girl." When Holt arrived at the meeting site on August first, he was arrested.

Holt faces a mandatory minimum of five years in prison when he is sentenced on September 21st. U-S District Judge Richard Cebull ordered Holt into custody.

Bart Holt of Missoula was arrested in an F-B-I sting, while trying to lure an underage girl over the Internet for sex.

The board revoked Holt's license for five years, or until he completes his prison term, whichever is longer.

Holt was arrested last year when he showed up in Billings, for a rendezvous with what he thought was a 13-year-old girl with whom he had been having sexual conversations over the Internet. The other person was actually an undercover federal agent.

The 47 year-old Holt pleaded guilty last month to coercion and enticement of a minor, and possession of child pornography.

Holt also agreed to forfeit two computers, a Web camera, a cell phone and a vehicle used in committing the crimes.

Holt's tentative sentencing date is set for September 21st.

A Missoula man has been sentenced to 10 years in federal prison for enticing a minor and possession of child pornography, charges he pleaded guilty to in June.

Bart Holt, 47, was arrested in Billings on Aug. 1, 2005, when he traveled to meet what he thought would be a young girl he'd made an Internet arrangement with a month before. In fact, Holt had been talking with an FBI agent posing as a teenage girl in Internet chat rooms.

Holt, a podiatrist, first met the agent in December 2004 at a time when the U.S. Justice Department was running an investigation called “Project Safe Childhood.” According to prosecutors, Holt engaged the “girl” in discussions about sex; during those conversations, reference was made to the girl's young age. Holt and the “girl” had a number of conversations over the next few months. During those conversations, Holt posed as a 19-year-old college student.

Eventually, however, he told the “girl” that he was 46 years old and a doctor in Missoula.

In July 2005, Holt made arrangements to meet the “girl” in Billings, where they would have sex despite the fact that Holt knew he could be arrested for doing so with an underage girl.

Holt arrived in Billings on Aug. 1, but wound up being met by federal agents rather than a teenage girl. He tried to flee, but was easily caught and arrested.

A subsequent analysis of Holt's computer revealed numerous images of child pornography that he had received through the Internet. According to court records, he also admitted that he'd had similar conversations with a 14-year-old girl in Great Falls and that he'd sent the girl sexually explicit images of himself.

Contacted by officers in Great Falls, the girl confirmed Holt's admission.

Holt was charged with coercion and enticement of a minor and possession of child pornography. U.S. District Judge Richard Cebull sentenced Holt to 10 years in prison and another 15 years on supervised probation. He also had to forfeit his cell phone, a computer and a Web cam.

The federal system has no parole, so Holt will likely serve most of his sentence. He has the opportunity to earn about 18 months off for good behavior.

A federal appeals court panel has upheld the sentence of a former Missoula podiatrist who pleaded guilty to coercing and enticing a minor into having sex, and to possessing child pornography.

In November 2006, U.S. District Judge Richard Cebull sentenced Bart Holt to 10 years in prison followed by 15 years of supervised release.

Holt was arrested in August 2005 after traveling to Billings to meet with a person he thought was a 13-year-old girl, with whom he’d been having online sexual conversions. Instead, he was met by FBI agents.

An investigation later turned up numerous images of child pornography that Holt had received over the Internet. Holt also admitted engaging in similar conversations with a 14-year-old girl in Great Falls, prosecutors said.

He forfeited two computers, a Web camera, a cell phone and a vehicle used in the crimes. And in July 2006, the state Board of Medical Examiners revoked his medical license for five years or until he completes his prison term, whichever is longer.

Holt argued on appeal that the lower court improperly applied a sentencing enhancement to his enticement charge for knowing misrepresentation of identity.
He admitted that when he first began having Internet conversations with the person he thought to be a 13-year-old girl, he misidentified himself as a 19-year-old college student, court documents said. But he said he revealed his true name and age — 45 — before sending her sexual Web cam footage and before traveling to Billings to meet her. Holt argued that he had therefore not misrepresented his identity in order to coerce or entice a minor to engage in sexual activity.

The lower court disagreed, finding that Holt initiated the online conversations in December 2004 and didn’t reveal his true age for six months.

In a decision issued Wednesday, a three-judge panel of the 9th U.S. Circuit Court of Appeals sided with the lower court, saying it “reasonably could have concluded that Holt was misrepresenting his identity in a prolonged effort to groom what he thought was a 13-year-old girl for illicit sexual contact.”

Holt also argued that the federal court “double counted” by applying two sentencing enhancements to his possession charge for essentially the same harm. The enhancements were for having a “vulnerable victim” and for “sadistic or masochistic conduct.”

The lower court again overruled Holt’s objection. The appeals court panel also upheld that decision in an opinion written by Judge Ronald M. Gould.

“Both the sadistic conduct and vulnerable victim enhancements account for the pain experienced by a young, small victim of child pornography, but the enhancements also account for distinct characteristics of the crime: The sadistic conduct enhancement accounts for the pleasure necessarily experienced by the perpetrator, while the vulnerable victim enhancement accounts for the inability of the victim to resist sexual abuse,” Gould wrote. “Because the two enhancements account for these distinct wrongs, it was proper, and no abuse of discretion, for the district court to apply both to the challenged criminal conduct.”
