U.S. plans to seek death penalty in case

In the first trial in eight years in which federal prosecutors in Chicago intend to seek the death penalty if they win a conviction, a podiatrist is accused of murdering a patient days before she was to testify against him in a fraud investigation.

The evidence against Dr. Ronald Mikos, 56, charged with fatally shooting Joyce Brannon, a disabled caretaker, is largely circumstantial, court records show.

Jury selection begins Wednesday in U.S. District Judge Ronald Guzman's courtroom. The process could take three days or more because a pool of up to 150 potential jurors must be questioned about their views on the death penalty.

Since federal death-penalty statutes were rewritten more than two decades ago, only Darryl "Pops" Johnson, a Gangster Disciple leader convicted in 1997 of ordering two suspected government informants killed, has been sentenced to death by a federal jury in Chicago....

05/23/2005 14:00:03 EST Podiatrist Gets Death Penalty in Murder



CHICAGO - A jury decided Monday that a Chicago foot doctor should get the death penalty for killing a patient to keep her from testifying against him in a Medicare fraud case.
Ronald Mikos, 56, was convicted earlier this month of murder, and was also found guilty of defrauding Medicare out of more than $1 million.

Mikos shot disabled nurse Joyce Brannon to death days before she was scheduled to tell a federal grand jury about how he claimed to have performed numerous operations on her that never actually took place.
