A Chicago podiatrist murdered a former patient just days before she was to testify against him in a fraud probe because the doctor believed she would be the lone witness against him, a prosecutor said Tuesday.

But a lawyer for Dr. Ronald Mikos tried to debunk that central government theory, pointing out that the massive investigation had uncovered that nearly 100 patients were victimized as part of the Medicare fraud.

"Killing one patient could not possibly end that investigation," Cynthia Giacchetti, one of Mikos' lawyers, told a federal jury in opening statements.

Assistant U.S. Atty. Jeffrey Cramer charged that Mikos shot Joyce Brannon three times in the back and then put the gun against the flesh of her neck and fired three more times, emptying his revolver. Brannon, 54, a disabled caretaker, was killed in the basement apartment of the North Side church where she lived and worked.

If Mikos is convicted of Brannon's murder, prosecutors intend to seek the death penalty from the same jury.

In addition to the murder, the 25-count indictment charges that Mikos, 56, defrauded Medicare of more than $1.2 million by falsely claiming to have performed more than 6,000 surgeries. He is also accused of obstructing justice by recruiting patients to lie to investigators about the fraud.

In opening remarks to jurors, Cramer said Mikos knew that Brannon was among the patients of interest to investigators after he voluntarily met with a prosecutor and agent in the fall of 2001 to try to convince them he had performed all 6,000 surgeries.

By early 2002, Brannon and three others had been subpoenaed to testify before a federal grand jury. One prospective witness, Charles Lobosco, was taking kickbacks from Mikos as part of the fraud scheme and Lobosco's daughter, another would-be witness, was mentally disabled and not a threat to Mikos either, Cramer said.

The other potential witness, an elderly woman, had led Mikos to believe she wouldn't testify against him either, Cramer said.

"Only Joyce Brannon stood in his way," the prosecutor told jurors. "He had to do something."

Three days before the murder, Mikos retrieved several firearms of his from Skokie police and called Brannon to plead with her not to testify. But Brannon later told her sister and a friend of the call and said she had refused to lie for Mikos.

After Mikos' arrest, the FBI recovered all the firearms in a storage facility rented by Mikos--except for a .22 caliber revolver that authorities believe was used to kill Brannon. An exhaustive search didn't turn up the gun, Cramer said.

In her opening remarks, Giacchetti cautioned jurors not to be swept up by the emotion of the case. She recounted how Cramer had dramatically described certain murder details in his opening but pointed out that Mikos wasn't seen anywhere near Bethany Evangelical Lutheran Church, 5942 N. Magnolia Ave.

And no physical evidence connects him to the murder scene either, Giacchetti said.

Giacchetti scoffed at the government contention that Brannon was key to the prosecution case, saying, "There were 90 other patients."

The decision over whether Dr. Ronald Mikos killed patient Joyce Brannon to keep her quiet is now in the hands of jurors, who will continue deliberations today.

Mikos, 56, is also accused of overcharging Medicare for thousands of foot surgeries he didn't perform. His attorney, Cynthia Giachetti, admitted that part of the story is true.

"I would expect and admit to you that there's massive Medicare fraud here," Giachetti told jurors in closing arguments Wednesday. "But please. Count 25, [for murder] it is not beyond a reasonable doubt."

Assistant U.S. Attorneys Jeffrey Cramer and John Kocoras painted Mikos as a cold-blooded killer who thought that if he murdered Brannon, who planned to testify against him, then a grand jury investigation into the fraud would disappear. "He was desperate. He needed to kill Joyce Brannon, and he thought he got away with it," Cramer said. "She was a good woman, and he silenced her. But he cannot silence this evidence."

Prosecutors say Mikos contacted every witness in the fraud investigation to coax them into not testifying against him for allegedly overbilling Medicare.

Brannon said she wouldn't lie and say he performed 72 surgeries on her feet. She called her sister to tell her about Mikos' phone call. Days later, Mikos killed her, prosecutors allege....

A woman who had two children with a Chicago podiatrist facing a possible sentence of death testified Wednesday that the children would be devastated if their father was executed.

Testifying during the second day of a death-penalty hearing for Dr. Ronald Mikos, Stacy Rosenfeld of Evanston said their 6-year-old daughter in particular would be hurt because "she's very connected to him."

Their youngest child, a 3-year-old son, was only about 6 months old when Mikos was jailed. "He knows there's this mystery daddy," she said of the son. "He doesn't understand what's going on."

But someday he will want to know "who his dad is," she said....

He got the death penalty

A Chicago podiatrist was condemned to death by a federal jury Monday for fatally shooting a disabled woman to keep her from testifying against him in a $1 million Medicare fraud case.

Ronald Mikos, 56, sitting at the defense table with folded hands and three husky federal marshals standing behind him, showed no emotion as U.S. District Judge Ronald A. Guzman read the jury's verdict.

"We find unanimously that Ronald Mikos should be sentenced to death," Guzman read. Under federal law, Guzman now has no choice but to impose a death sentence.

Mikos was only the second defendant sentenced to death in the history of Chicago's Everett M. Dirksen Federal Courthouse. The first, street gang leader Darryl "Pops" Johnson, is awaiting execution for the murder of two federal witnesses.

Mikos can appeal his death sentence. His attorneys, John Beal and Cynthia Giacchetti, left the courthouse without comment. Mikos was convicted May 5 of defrauding Medicare out of more than $1 million by billing it for thousands of surgeries that he never performed. He was also convicted of murdering Joyce Brannon, 54, a nurse, days before she was to testify against him before a federal grand jury....
